Can my dad sue the assisted living facility where my mom died & he still does not have his refund after 4 mths.

The facility and their home office; the people we need to talk to now don't answer my calls nor return my msgs. They sent a check a couple of mths ago made out to "the estate of", etc. which is not good to my dad without setting up an estate which is money he doesn't have & he paid for the facility with a personal check and credit card. They told me to return that check and they would send another check made out to my dad. Nothing yet after mths and dodging calls, etc. What they had went to my dad thru mom's will, not enough to probate. My dad needs his money???? My dad is 91, has dementia; I'm his poa.

I don't practice in NC, but various states have a process for transferring assets for small estates (i.e. smaller than required for probate). This information is sometimes available online. If that's available to you, you can follow follow the steps and send them a written demand. You might considering consulting with a local lawyer. A strong letter from a lawyer might be in order.

I'm sorry about your loss and the stress this is putting on your family. In NC, depending on how much is owed your dad may be able to open a small estate. If your mom's will left everything to your dad and the amount at issue is $30,000 or less, the small estate won't require a lot of time or expense. You and your dad can go to probate office at the county courthouse and fill out the paperwork and then cash the checks made out to your mom's estate. If the probate estate is more than $30,000 then a full probate will be required and you would be well served hiring an attorney.
