In Florida can an eviction summons and complaint be served as a cross-claim in a civil action?
I answered the original complaint from the original plaintiff, however on the face of the original summons there was notice of a cross-claim action. This doesn't seem proper. I then received a 3-day and a no remedy seven day notice on the same day. It seems the 3-day notice would cancel out the 7- day notice. Then I received, awhile later, a cross- claim eviction summons and complaint. Fla rule 1.170(g) seems to show that since I answered the initial summons another summons is not served in a cross-claim according to Fla rule 1.080(b) and the word shall is used. Also flat stat 51.011 refers to only plaintiff's initial pleadings not cross-claim plaintiff's initial pleadings. Finally, rule 1.140 allows 20 days to answer a cross-claim, not the 5 days under s. 51.011 summary procedure.
