I need to kno if this is best way to get my green card 2) Should I apply asylum? Will obvious need a good lawyer to help me get a reason and need lawyer with good success rate so lawyer trusting and can guarantee my story with some afadavit 3) EB5 is option? I read on immigrant self help site that you can buy real estate in city like LA and if its more then half million then you can get a green card Please kindly asnwer!

Your U.S. citizen child cannot sponsor you for a green card until the child is 21 years old. EB-5 investor green card requires that you invest in a commercial enterprise -a business that will employ 10 U.S. workers , not real estate. Asylum is very fact specific. You need to schedule a consultation with an immigration lawyer if you want to thoroughly explore your options.

You really need to get some serious legal advice. You need to understand the situation you are in. You haven't read right. And an internet blog isn't going to help.

Your assumptions are generally wrong. I agree with other counsel. You seriously need to consult with an immigration attorney. Mr. Smith is an attorney with over 25 years of immigration experience with complex immigration issues and successful filings. His response to your question is general in nature, as not all the facts are known to him. You should retain an attorney experienced in immigration law to review all the facts in your case in order to receive advice specific to your case. Mr. Smith's statement above does not create an attorney/client relationship.

Very typical of many desperate intakes with children. They obviously came here and ... "produced US citizen children whoa re legal and their parents are now" (I got scolded for using the term anchor babies even though that's what they are). I'm not even sure an immigration lawyer can help you at this point unless you are willing to divorce your husband in your home country and marry one here. 1. No. That's not how it works. You'll likely be punished for trying. 2. You can't just make up asylum claims. That's why asylum offices deny people 3. EB-5 requires investing in a for-profit enterprise with $1 million generally or $500000 in an economically depressed area... i.e. NOT SAN JOSE. You can't just buy a house and get a green card. 4. No. Your child must be 21 to petition for you and since you have overstayed your visa you would have to leave the country anyways because you are barred. Just... no.
