I'm not sure how the police officer could put you at fault if you got rear-ending. In any event, your mother can make a claim against the other driver's insurance company for her property damage. If there is a valid claim against you, and you were an excluded driver, you might have to step up to the plate and pay for the other driver's damage.

Use the Find a Lawyer tab to locate an attorney. With a finding of fault it is completely possible that your mother would be sued as the owner of the car. You should not have driven the car without insurance.

You're more likely to find a lawyer to help you if you contact their office directly, as opposed to using this question and answer tool. You can use the "find a lawyer" tool on this site, or Google, to search for lawyers.

You could offer to pay for the damage, but why do that if it was not your fault? Get a free consultation with a local attorney to discuss your options.

Despite a botched police report, you should still be able to recover with the right help. Make SURE you contact an attorney in your area that specializes in personal injury and car wreck cases. I have been able to over come poorly written or documented police report on many occasions. It is not uncommon for these reports to contain serious errors. In fact, I was once the 'victim' of a police report which had me listed as the at fault driver. We were easily able to overcome this error with pictures from the scene and witnesses' affidavits.

Did the police officer cite why they wrote you the ticket even though you were rear-ended? If there's a valid claim against you but you aren't on the insurance policy, and you don't want your mother to pay for this, you might have to do so out of your own pocket. However, I wouldn't do anything before contacting an attorney. Your case is unusual and you could benefit from a consultation. It should be free.
