How can i get my blood test results for a DWI case?
Anonymous6 views5 answers
I was arrested on 12/07/ 2014 for DWI, but i don't think I was drunk. After three weeks DPS sent me my Driver License for unknown reason. but suddenly i received a court date. I tried to get my blood test from DPS by email , but they tell me there are no records in my name. i think the results should be in my favor if i could somehow get the results.
thanks
Your lawyer will be able to get the results once you are in court. HIRE ONE. You do NOT want to go through this on your own. Call a lawyer with DWI and criminal defense experience. Just becuase your blood results may have been over .08 does not mean that you are guilty of DWI. Many of us offer free consultations and initial meetings for cases like this. Call a few lawyers, meet with them about your case, then hire the one you best believe can keep this off of your record.
I know this is not what you want to hear BUT you are being charged with DWI. Do not go at this alone. Get a lawyer who does DWI.
The reason I say this is because if they took your blood, they sent it to the labs and have had it tested to find out the BAC-Blood Alcohol Content Levels. They will use this as evidence to show that you were impaired when driving. The legal limit is .08 and honestly its fairly easy to reach .08. If you hire an attorney he can get the blood test, video, offense report and all evidence of that case.
As for not thinking you were drunk or the results being in your favor... I wouldn't put to much faith in that. Get a lawyer to look at the results and make sure that the cops complied with the laws in getting your blood.
If you willingly gave blood on request then the reason that DPS sent you your license is because you cooperated (which is required by the receipt of the license in the first place) and they do not have the test results yet to show you were in violation (above the legal limit), if you were. It does NOT mean that you will not be further prosecuted or that you are innocent.
If you are in Harris County, you are already appearing and court and you absolutely need a lawyer. Your lawyer will be able to review the blood test results.

You definitely want retained counsel you trust and have confidence in. Consult with an attorney as soon as you can. Many offer free consultations. DWI conviction will really hurt you.
The prosecution is required to furnish your blood test results. This is usually obtained in the discovery in your case. Blood tests can take a long time (up to three months) to appear. This is because crime labs have a lot of work to do. Your attorney should provide you with this information as soon as it is available.
