Nursing home escape

2 views 6 answers
My father was recently admitted to nursing home with dementia. Last night he came home. He left nursing home and somehow managed to find his way home.. The nursing home didn't realize he had gone missing until I called to report. They failed to notify me with the next step and I arranged my father to be transported back to the nursing home. There were zero communication from the nursing home. I am frustrated with their level of treatment and service. What legal action can I take?

Thankfully, your father is safe. A lawsuit should wake them up and hopefully prevent this in the future. However, there would not be a financial gain. Speak with management or consider another facility. Good luck.

This is about as serious of a failure as can happen in a nursing home. Thankfully your father is safe but this could have been a disaster. I've handled several elopement cases where people have been injured or killed. At a minimum this should be reported to your state agency that monitors nursing homes and you should consider discussing your options with an attorney. You should also consider moving him to a more responsible nursing home.

Poor job by the home but since he is ok a lawsuit is not the answer. Bring the matter to the attention of the administration or look for a new facility.

Having handled several of these cases that have resulted in a fatality, I can't emphasize enough the importance of going to whichever facility is going to care for your father and going through all of the measures in place to prevent elopements. You should ask if the facility has a Wanderguard system and see that your father is fitted with a Wanderguard bracelet. You should ask to look at all exits and ask if any are used by staff for such things as smoking breaks--those tend to be unalarmed. See if there is a secure unit. Ask what the facility's protocol is for when an exit door alarm is sounding. Some facilities conduct bed checks rather than sending someone outside right away. I agree that you need to report the incident to the Department of Health so that they can check the safety measures that are in place and the ability of the staff to carry them out. Good luck.
