I'm looking for an affordable attorney (possibly take payments) so that I can get this under way. My question is that I have a child support order and i'm worried about wage garnishments. How long will it take them to start. I start my new job this week and they do direct deposit only. Does the friend of the court get there money first? How much can they take from my check if they do? Very worried and financially frusterated.

One of the rules of this forum is that we cannot solicit business here, but you can use the "Find a Lawyer" link to search for an experienced bankruptcy attorney in your area. Most attorneys will accept payments, but the full fee will normally have to be paid before the case is filed. If the lawsuit filed by the credit card banks have been filed recently, there are things that can be filed to establish that you have a defense at least to the amount that the plaintiffs assert that you owe which will give you and your attorney time to get the fee paid and file your bankruptcy. As to your questions about when the garnishment can start, the creditor must be granted a judgment before the garnishment can start. If you will use the search tool, you should be able to talk with an attorney that can answer all your questions. Most attorneys will provide you with a free initial consultation.

Any garnishments for child support will take precedent over garnishments for a debt, assuming that FOC begins their garnishments immediately. You can help with this by making sure FOC has all of the information for your new employment. You can find an attorney on that handles these types of cases in your area. If you are worried that the creditor will begin garnishments immediately, you could file a Motion for Installment Payments yourself. A link to the form is here: http://courts.mi.gov/Administration/SCAO/Forms/courtforms/garnishment/mc15.pdf If this is just one credit card, realize that many creditors will offer you a lump sum settlement. Something to consider, and another way to avoid a garnishment. Kelly G Lambert III

Contact a few attorneys and explain your payment preferences - I'm sure many will be more than willing to work with you. Good luck!
