Are the Statue of Limitations for Fraud in New York 6 years?

Hi, I have become a victim of mortgage fraud, and was wondering if since this fraud was committed against me in 2010, if it would still be able to be brought to court? I know who committed it against me, and I am completely ready to file a motion in court. Thanks, Michael

Generally speaking, 6 years for actions based on NY statutes of fraud. Check with a local lawyer to verify based on your specific facts.

Mortgage fraud falls under federal law and your limitations period is one year. Without knowing your actual facts, you may have an action under the act that protects home owner equity. Or you may have a truth in lending case. There may be more statutes that allow suit, but the Fed gives you a year. Local courts can and do extend the statute but we don't know your facts to make that determination.

The statute of limitations in New York for fraud cases is 6 years. If you believe you were defrauded by the company or bank that obtained your mortgage you should bring your paperwork to an attorney for a consultation.
