Police raid on rental property question!

2 views 2 answers
I had a tenant that abandoned Her rental left no forwarding address & the police came looking for her a month later with a search warrant. They forced open the back door & pulled it open and damaged the frame & drywall they even broke apart the all the kitchen cabinets when they were visibly empty & left a ton of damage for no reason seeing that the house was empty & had nothing in it! I had a new renter that was supposed to move in the next day & now the house won't be ready for another 2 weeks! The tenant now took their money back to move into another place. I have lost my renter & now have to fix the damage done by the police. When I asked who is responsible for the damages they told me "That's what you get for being a landlord" How do I get them to pay for the damage done by them? Tia

Their execution of a search warrant was signed off on by a judge based on facts they presented in the warrant paperwork. Unfortunately, they did not know your tenant had left. I don't think you have any realistic recourse, but call DPD headquarters and see if there is a claim form you can fill out. You might have to write this one off.

I'd talk to your insurance provider to see if this is covered in your policy. It's possible, as stated in prior advice, that you can file a claim versus the police department. Otherwise they are probably protected at some level of government immunity from a damages claim. So it's either file with police department, or call your insurance carrier to see if this is covered.
