When does child support end in the state of Florida? At 18 or at graduation from High School?

Child Support 2 views 3 answers
My son just graduated High School on 5/21/15 but will not turn 18 until 8/16/15. My ex-husband pay a child support through a payroll deduction. The day before my son graduated my ex-husband sent me an email stating that I need to notify his employer that I no longer due child support as of 5/21/15, since our son graduated. It was my understanding that child support is provided through the age of 18. Our Final Judgment reads "Until the child reaches the age of 18, graduates from HS, or 19 if the child is in HS performing in good faith with reasonable expectations to graduates, marries, becomes self-supporting, dies, or otherwise emancipated, which ever comes first." Our divorce was finalized in the state of Florida, 8/16/2001, Orange County. Can you please clarify this for me. Thank you.

If your son graduated at 17, then child support should continue until he is 18. You should contact with employer and tell them that they are personally liable for his child support if they do not deduct the child support as ordered (assuming that there is an Income Deduction Order).

18 is the minimum ending age. If the child would have graduated from high school after turning 18 but before turning 19, then child support would have continued past the age of 18. Therefore child support will end in August. Congratulations on your son's graduation!

Your order says "until the child reaches the age of 18, graduates high school...whichever comes first." If your order truly states that, your son graduated high school before turning 18, so child support should end. However, because that is not normal, it will probably take an order to end it before e natural end of the child turning 18.
