How do I keep my car from being repossessed if not behind on payments?
Anonymous3 views3 answers
I have an auto title loan and they say I am behind on my payments. All payments are up to date on my end. I've tried talking to them and finding out what happened but they are rude and not very helpful. I just received a call from a recovery firm for the repossession of the car. What can I do since they have apparently not applied a payment somewhere. I am now due for 5/28/2015. I'm not 30 days late so how can they just decide to repossess my vehicle whenever they choose?

Check your contract to make sure you've complied. Verify your payments were made. Send copies of proof of payment in a certified, return receipt requested letter.
You may consider asking a lawyer to write a strong letter on your behalf.
Phoning is not the most effective approach. Write a letter with documentation of all your payments. Then tell them if they wrongfully re-possess your car you will sue them. Tell them if they disagree with your documentation they should advise you in writing. I would send the letter overnight delivery requiring a signature of the receipt.
Looking at this from a practical, rather than legal, perspective:
Many years ago, friends' business had financial problems, so they fell behind on their car payments. They avoided repossession of the car by never parking it anywhere near their home. They had to walk some distance before and after using the car, but they managed to keep it.
