Can a child press charges against their parent for vandalism when property is destroyed as punishment?

I paid for 1/2 of an iPad for my son's birthday. He had it taken away for misusing it and for failing classes in school. Once it was taken away, he stole it back. I confronted him, took it away again and hid it. He rummaged through my office and bedroom until he found it and stole it back again. This pattern repeated for at least 6 months and eventually, I just threw it away. Of course, he found it in the trash, so the next time, I smashed it and threw it away. He wants to call the police and report me for vandalism, to which I replied that I have authority over him and his belongings until he was 18.

Here is the problem with his case, 18 PaCS 3304, Criminal Mischief requires the destruction of the property of ANOTHER. Meaning yiu cant be charged for destroying your own property. You bought half of it. No police officer in his right mind will want any part of that case. People dont bring charges the CW does. Good luck, he sounds like a disturbed kid.

It is not a crime to discipline your son in the manner you have described. Good luck with parenting.
