So I am currently living with my soon to be ex wife. She filed for custody of the kids and I would like to know if that is something that's legal? Can this case be thrown out of court?

She can file for custody while you live in the home but the fact that you live in the home with the children will affect the outcome of her petition. Make sure you have representation.

The fact that the two of you live together means that she is not entitled to support.
