How can prolong a eviction?
Anonymous2 views2 answers
I was given a 30 day notice. The landlord said if i do not move out by that time he will have the police arrest me and force me to out. I tried to pay him rent but wouldn't take it. I have no ware to go.. How can i prolong this as long as possible so i can save up for a new place.. The landlord was also waiting for me at the property to serve me with the papers because i was out shopping.

The issue is not merely "prolonging" the eviction. You need to assert your rights as a tenant. The landlord can NEVER force you out you can only be evicted by a Judge after notice and a trial. Every landlord must follow the procedure or face steep penalties.
Please hire local tenant's rights counsel right away. If you cannot afford counsel seek out a local non-profit who has a tenant's rights department.
An eviction can have a long term effect on your quality of life and a good tenant's rights lawyer can avoid almost all of those things, like knocks on your credits, in almost all cases.
After the 30 day notice expires, the landlord cannot have the police arrest you. The landlord would have to take additional steps before the sheriff would lock you out. Among other things, the landlord would have to file a court case, win, and obtain a "Writ of Possession." This process takes several weeks.
