Child and friend snuck out during two day period. Upon room search stolen property was found and returned to the owners. The friend threw away his share of the items and one of the families has informed that charges will be pressed if items aren't returned. They can't be returned since other child has discarded of them. What penalty will child be facing?

If the case is being investigated, most likely criminal charges will follow. You need an attorney now. For this type of case, it is actually better to have one represent you before charges are filed - they can then speak with the police on your behalf. Do not attempt to handle this on your own. The saying that anything you say can and will be used against you is VERY true. Kelly G Lambert III

Penalty? It depends upon the charges, but you can surely expect that restitution will have to be paid. It is a joint and several liability concept. Each is responsible for the entire amount. It is not divided up. Both will be charged. It is time to get an attorney for the minor.

I agree with the answers by the other attorneys. It certainly appears that criminal charges will follow. Look into getting an attorney on retainer asap. Do not talk to the police! In my experience, the police only look to gather evidence to support criminal charges, not evidence to help the 13 year old. An attorney could talk to police for you, if your attorney thinks that is a good idea. Do not attempt to handle this on your own.
