Landlord Tenant Law in Manhattan question

Real Estate 3 views 4 answers
I currently reside in off campus housing, essentially an apartment building owned by the private University I attended. I did a 12 month Master program and have been renting a studio from the University. I am now being asked to leave as my year lease is up. As a tenant in Manhattan in this building owned by the University do I have any rights to continue to live in the apartment? I have paid my rent every month and the only reason I am being asked to leave is because I have received my degree and am no longer affiliated with the University. Do I have any legal rights to remain in my apartment?

It would appear that you have limited options regarding your continued occupancy at the premises. If the apartment is in fact owned by the university, generally speaking they have a provision in the lease that you lease will not be renewed when you become affiliated. You may be able to extend your time either through negotiation or court proceeding . I would suggest you speak with a landlord tenant attorney.

If the lease is up they can ask you to leave. This sounds like STUDENT housing. Why do you think you can reside their when you are no longer a student? Where would the students live if everyone stayed after graduating?

Unfortunately not. Once the lease expires the landlord is under no obligation to renew the lease. There are exceptions for rent controlled apartments but that would not seem to apply here.

Dear New York Tenant: Student tenants who rent living space in buildings own by the educational student usually sign leases limiting the duration of the tenancy to the continued affiliation of the student tenant with the educational institute. Those leases are generally known as affiliation agreements. The buildings owned by the educational institute are exempt from rent regulation. Even in a mixed-use building the affiliated tenant does not gain rent protection when the affiliation lease ends.
