Arrest warrant on my husband because of serious charges. What can I do to keep him from jail?

I have a Permanent Protection Order against my husband due to Domestic Violence. Now they issued a warrant for his arrest and he is charged with: Aggravated Battery on Pregnant Female and Battery for Domestic Violence. I understand this are very serious charges and he really doesn't deserve to go to jail, I know he has realized his wrongdoing and all he needs is to assist to a batterer intervention program. I am trying to contact the State Attorney to express my wishes to drop the charges, even tho I know they would most likely proceed. If I withdraw the Protection Order would it help? Can they deny me because of the criminal charges? The incident was the result of him trying to push me away when I tried to shut him up by covering his mouth with my hands. Does this count as self defense?

You can have the Order of Protection dismissed if you want. The decision on whether to prosecute your husband or not rests solely with the State Attorney's Office. Of course they can/will factor in your request, but they are not bound by it.

You have asked a number of questions in a single post that are difficult to answer without a full analysis of the facts. This requires a face to face meeting with an attorney. I can tell you that the decision to prosecute your case or to drop the charges rests with the Assistant State Attorney who will be assigned to your case. You as the victim, have a constitutional right to express your desire to drop the case, or see him get batters intervention program rather than jail time. The best way for you to get the answers to all your questions would be to consult with a criminal defense attorney and preferably not the one your husband will use. Keep trying to contact the State to express your wishes. You may also wish to consider hiring a lawyer for him. An experienced criminal defense attorney in your area will help you to have the charges cleared.
