What actions can I legally take regarding my apartment?

3 views 2 answers
I live in an income based apartment complex. They have a dog policy stating they allow them up to a certain weight. My dog is a registered service animal for emotional support for me. I don't get along with one girl in the complex and she has started knocking door to door talking bad about and asking these people to sign a petition, to get me evicted because of my dog. Can she legally do this? Apparently the apartment management lady told her if she got enough signatures, I would be evicted. My neighbor called me yesterday at work and gave me this information. Can they evict me for my dog even though they already approved him to be there and they have my paperwork proving he is my service animal. What legal grounds do I have to stand on and what actions can I take?

I wouldn't worry about this too much.. As the Americans with Disabilities Act pretty much protects you from Discrimination in housing based upon the Service Dog. Additionally, as you are in an income based complex, I would assume that you would be eligible for Legal Aid Services. If something comes about from the situation (they start the process to eviction) you may want to contact Southwest Legal Aid Society to assist you in this matter. You can reach them at 1-800-318-2596 or http://www.svlas.org/

Since your animal is a reasonable accommodation for a viable disability, you cannot be legally penalized. Regardless of the alleged signatures, the landlord would face potential severe penalties. Good luck...
