Modification of parenting

2 views 2 answers
One year has passed since judgement and parenting time. During that year custodial mother was found in contempt of denying me access ordered to pay attorney fees. I understand I we must go through parenting conference and try come to an agreement. Since the contempt of hearing she has at least not kept me up as to where child is for day care judge told her although she has decision making I am to be kept in loop. She also claimed the child on her taxes this was my year again contempt of court. So do I just do the parenting conference and bring these issue up or do I do both and file for contempt again?

What to file depends on your ultimate goal. You would file to modify parenting time to (presumably) expand your parenting time if reason exists to support that change. Parenting time and legal decision-making are independent concepts even though they share the statutory factors under §25-403. You should consult with a family lawyer who can help you decide what course of action is appropriate when given more detail about your situation.

Thank you for the questions and comments. If she is violation of the current, standing orders then yes, a motion for contempt is probably the way to go. There are plenty of questions to be answered, though. Do you want a modification to the current parenting time order? And with her continual abuse of court orders, you may want to consider joint decision making or you become the sole decision maker. In regards to her using the child tax deduction this year, are you also saying that the court has already found her in contempt for doing so? If not, certainly -- have an attorney file all of these issues with the court. Many attorneys offer free consults on these matters. Call or email to schedule a no-cost discussion.
