Hi. May I transfer money from a joint account to a personal account during a divorce?
Anonymous2 views2 answers
I have shared a joint account for 20 years with my wife. We are now divorcing. I have moved in with a friend, but that is not an option in 6 weeks. I would like to transfer some of my salary to a personal account use it to pay for my new basic living, expenses (rent, groceries, utilities, gas, basic needs(computer, beds for sons), my renters insurance) and leave some of my salary in the joint account to pay for my spouses rent, all insurances (renters, car, life), utilities and car payment. Am I able to do this without her taking legal action against me?
Thank You
The first thing you should do is stop having your paycheck deposited into the joint account. Have it put into your separate account, and then transfer the money you want your wife to have to meet her monthly needs into the joint account. If she is not satisfied with the amount you provide for her, she can ask the court to have you pay temporary maintenance. However, you would be much better off sitting down with a family law attorney for a consultation where you can lay out the family finances than getting advice from an Internet bulletin board. The question is not really can you what what you are asking. The question is should you do it, and, if so, how?
