My husband was deportes for 20 years he's been in mexico for 1 year already. He has a son that is a us citizen but he wont be 21 unti 7 morw years. By then can he file a I212 and he son claim him? We do have two children us citizens. Also i have daca but i do have a brotheebrother that is a us citizen can he claim me? And if he can does it long?
It depends what you mean by "deported for 20 years." Presumably you mean deported due to a conviction for an aggravated felony. If so, there is a lifetime bar to admission and a waiver available after 20 years.
yes, your son when 21 can file a petition for his father, but depending on why he was deported, he may need a waiver ion addition to I-212 too. in your case your brother can and should have filed for you, but it will be about 25 years before your visa becomes available if you are also from Mexico.
