i was in class and sleeping on a paper. All the sudden the teacher pulls the paper right from under me. It scares me and my initial Insinct is to pull back so I pulled back and she pulled back and it went back and fourth aggressively for about 25 seconds. I was in shock after this happend. Can I press charges. Or can I sue. And if so what kind of lawyer do I need
What are your damages - a paper cut, perhaps? Not seeing a jury being sympathetic under any theory you might find to sue for. And assault by paper extraction is not something I believe any prosecutor would follow up on.
Now, what is the real question - what penalties is the school imposing on you?
The teacher had the right to wake you up. You are not allowed to sleep in class. There is nothing here to sue over. I suggest you get more sleep at night.
