I'm a Canadian Citizen, Married to an American Citizen, he lives in California, we currently have an I-130 application pending. Can I travel to visit him, while my case is pending? I plan to stay for 14 days and return to Toronto. I hold a Nexxus trusted travel card so I don't see an immigration officer I just scan my card and proceed to security check. We got married in Toronto Canada and Honeymooned in California. I believe it will be at least 5 months to complete the visa process. Please advise.

Yes, you can attempt to enter the US ... the Nexus pass will help. PS It will take more than 5 months before you go to Montreal for the final visa interview. You might want to have an attorney consult with you via Skype to get things organized so that you won't lose time between the 4 US government agency 'phases' that will take place.

We have had spouses in similar circumstances as your admitted without a problem. This isn't a guarantee you won't have a problem. But, I don't consider the risk so high. You might consult an immigration attorney to discuss this fully.
