We both are chinese and we were married in the chinese general consulate in Germany. We have a marriage certificate in chinese (red book) and one in german, both were provided by the general consulate of China. As we submitted our I485, we were required for additional evidence to provide our marriage certificate which has been registered with the proper civil authorities in Germany, where you were married, in order to establish the relationship to the principal applicant for adjustment. We could only provide a marriage certificate that is provided by the chinese consulate, but the VO denied my case because it was held that when determining the validity of a marriage for immigration purposes, the law of the place of celebration of
the marriage will generally govern.
Your iteration of the facts is confusing. You mentioned a VO which means a visa officer at the U. S. consulate. However, you also mentioned FORM I – 485 which is filed with USCIS. Were you refused the immigrant visa at the U. S. consulate or were denied the adjustment of status with USCIS? I suggest that you retain an experienced immigration attorney to assist you with the issue of the marriage certificate. Good luck to you.
