Is this a legal land contract?

I agreed to do a land contract over a year ago and one of the sellers never signed the land contract . I talked with my landlord because I had a personal situation and had to move and he verbally agreed to allow me to move . I cannot find record of any contract filed and now over a year letter he's contacting me saying he will take me back to court if I don't give him money .... Any advice would be helpful

It is unclear what you are asking, but if the seller never signed the contract to sell the property it would seem that you do not have a valid contract. I am also not clear where the contract would be "filed," especially if you are talking about a lease. If your old landlord is saying that he is going to sue you, you should ask him to send you an email clarifying the basis for suing you. If the lease allowed you to break it on his verbal permission to move you have a valid defense to him enforcing the lease. You should meet with an attorney to discuss all the specific facts to get an accurate answer to what rights you have.

As the previous response indicated, your question is a bit confusing. If you are asking whether a land contract has to be signed by all parties, then the answer is yes. Land contracts must be in writing, contain certain provisions, be executed by all parties and recorded in the county where the property is located. (see http://codes.ohio.gov/orc/5313.02). If you are talking about a lease and you moved before it expired without written agreement from the landlord to release you, you may be liable for damages resulting from the breach. Since your situation is a bit confusing and depending on the amount of money at issue, I would suggest that you consult with a local attorney concerning your rights and options. An attorney can review the documentation at issue, obtain more facts and help guide you through the situation. Many offer free initial consultations. If you receive service of a summons before you've consulted with an attorney, you need to take action immediately to preserve your rights and avoid the possibility of a judgment being taken against you. You can search for an attorney to assist you on or contact your local bar association for a referral. Good luck!
