Can I file for a marriage liscence if there is an out of state no contact order in effect against my fiance?

My situation was a miss understanding, and I can't get the order dropped because he is in noncompliance. Will he go to jail when we go to file for the liscence?

If there is an out of state Order of Protection pending, it usually isn't going to be enforced within a different state, so you should be able to get a marriage license in a different state safely. Good luck. and congratulations.
