F-1 changing visa status to B-2 or getting OPT to extend stay?

3 views 3 answers
I have an F-1 visa and I just graduated. My 60-days grace period will end before my newborn is 1-month-old and is allowed to travel. I heard the options to extend my stay for a couple of days are to request a change of visa status or an OPT. What is a better option?

If it's an "OPT" based employment authorization document you'd like to apply for, then that must be done in a "timely basis" in order to be granted. Speak with your school's designated official ('DSO") and/or foreign student adviser about it.. A "request to change visa status", i.e. a Form I-539 application to COS is not easily granted by USCIS. But if you have no choice, that's option you'll choose. Don't try to do that one on your own.

It would depend on what you want to do. OPT will allow you to work in the USA for 12 months while a B non immigrant extension will likely be granted (if you qualify) just for the time requested and will not allow you to work.
