I filed my answer in my divorce case a little over a month ago. Can I still file a counter-petition?

Husband filed for divorce. I filed an answer and we have since exchanged our financial documents. Can I still file a counter-petition or is it too late?

Depending on how long ago you filed your answer, you may have to file a Motion for Leave to Amend your answer and file a counter petition and get permission from the Court. These types of motions are routinely granted and often stipulated to by the parties. However, I would recommend that you speak to a lawyer to discuss this and the substance of your counter-petition. Best of Luck.

Mr. Vaghaiwalla is correct, you likely will need to file a Motion for Leave to Amend your Answer to include a counter-petition. You will also have to pay the local filling fee to the Clerk of Court for the counter-petition. These types of procedural matters are much easier to handle using an attorney.
