Withdrawal of SSI application and payback of benefits

Social Security 5 views 3 answers
I'm receive SSI and have inherited money that takes me over the resource limit. I called SSA and they framed their response as "withdrawing my application". I subsequently looked up that phrase only to see that 'withdrawing the application' involves paying back benefits received. Upon seeing that I became scared to death. I've been on SSI for several years. Does 'paying back benefits' mean ALL the dollars I received while on SSI? If so, it would make the inheritance close to useless, and would probably mean in short order I would have to reapply for SSI all over again. I understood there were alternatives (e.g. supplemental trusts) but felt the inheritance was large enough to forego that option. No so though, if I have to pay back years of SSI. Is that what this will be?

You should not have to pay back all the benefits you ever received as long as you were disabled and at the time met all other requirements for SSI. Your application was already filed and approved. Basically, what you can do is just report the inheritance. Your benefits will then stop unless and until you meet the income and resource requirements again. You mentioned you understand the alternatives. Here's a link to resouces and assets that will not count towards your resouce limit. http://www.socialsecurity.gov/ssi/text-resources-ussi.htm

You would have to pay back any ssi benefit you received after the inheritance money became available to you. If you just received it last month, for example, you don't have to pay pay the benefits you received 7 years ago.

typically you would only need to return the money you received after you went over the resource limit.
