I received a summons for unpaid hospital bills that the hospital had me send myself. What do I do next?

I paid a visit to the ER some time ago. I did not know that I still had insurance through my fathers work. The insurance would not pay the bills because there was a $3000 deductible that had to be paid first. When the insurance through my father had run out I received my own insurance. The hospital had me send the insurance company the bills myself. Then I received the summons stating that I was being sued by the hospital. I do not see a court date on the summons. I called the insurance company and they said that the hospital should have sent the bills not me. I took the summons to the court house and they told me to write a letter disagreeing with the complaint and send it to the lawyer. Is this the right thing to do. I am 21 and have never had to handle this type of thing before.

You have a very limited time to file an answer once served with the complaint. If the service was by a process server, it is 21 days. File a letter with the court (include the Case Number) and send a copy to the Hospital's attorney. Explain the situation in your letter. The court will set a Pre-Trial date or a Trial date. Appear on that date and discuss with the attorney. Good luck1

This is very common, unfortunately. Doctors and hospitals often do not bill insurance or patients correctly, and are quick to then send patients to collections or sue them. If the claim is for over $1,000, I suggest speaking with a debt collection attorney with experience in hospitals and medical bills. As for the summons, there should be a date stamped on the summons when it was accepted by the court clerk. You only have 28 days from that date your received the Summons to submit an answer. You can hire an attorney to do this, or your can submit your answer yourself, and be sure you mail a copy to the hospital's attorney too. Not answering will mean you are in default and the hospital will quickly have a money judgment against you.
