I had a felony in 1986 that was to be dismissed after I completed my probation. It was not dismissed.

Criminal Charges 4 views 4 answers
I had gone to the court several times and kept getting the run around. Well in 2015 I was finally able to get it dismissed. But my question is this. I have lost 2 jobs because of this felony (the companies did know but I couldn't get a clearance) Do I have a case against the county because it did damage my life I was a single Mom of 3 raising them on 9000 a year because I couldn't get a good job because of the felony that should have been dismissed because of a computer glitch and their mistake. I do have some collage education so I was able to get jobs in the medical field if I could pass the back ground check.

This is actually not a criminal law question. You probably ought to look under civil litigation because, if you have a remedy, it would be due to suing the County.

Whether you have a meritorious claim is really hard to determine based on the short description, however I doubt you could bring a claim under the circumstances.

Most attorneys give free consultations, give some a call and discuss your situation. A Criminal Defense attorney can help you get your documentation and some answers as to what your deal was/is and whether anything further can be done at this time (including sealing options). If your deal/dismissal paperwork supports your claims, you can address your records and then a litigator can assess whether or not you are likely to prevail in a suit against the state (which is often an uphill climb). Good luck.
