My ex husband stopped paying child support for 7 months now. Can he stop child support if he filed petition for modification? department of revenue send me application to file.
Child support continues until a judge says otherwise. Now, the amount of back support due may be altered in that, once someone files a supplemental petition to modify, the date of filing of that petition may act as the date that child support changes, even though the hearing may not occur for months.
No, he can not stop paying simply because he thinks it should go down. Since he has requested a modification, you can ask the court to schedule a hearing to get the issue resolved. You can also file a Motion for Contempt.
No. He cannot just change the amount without a court order. I agree with my colleague that the court, if the modification is granted, can make it retroactive to the date he filed his modification.
You need to file a Motion for Contempt to let the court know that he is not complying with the court order. Consult with an attorney and do it right away.
