You should seek the advice of an attorney. If you do not know an estate attorney and are not sure of who to search for on the Internet or .com, I would recommend that you contact the local bar association in the county where you live to ask for the lawyer referral list. This referral program is a cost effective (cheap) method to briefly consult with an attorney who can provide you with some preliminary advice on how to proceed.

I would highly suggest talking with an attorney in New York who specializes in Special Needs Trusts and/or government benefits like SSI. An attorney would want to see how the special needs trust was set up and drafted for your son prior to giving you an opinion on your options. After reviewing the trust, an attorney would likely be able to provide you with some possible avenues to address your issue. has a search feature where you can search for attorneys that are near you in Rochester. I have also tagged this question with the "Special Needs Trust" tag, which should hopefully allow attorneys who practice with special needs trust to offer you some further suggestions on how to proceed.

This can be complicated but it's not impossible. Seek the advice of an experienced Estate Planning attorney in New York. See .com under the link called 'Find-A-Lawyer'.

Sounds like you need to a hire a lawyer so she/he can speak to the trust company and investigate where the funds went, and what is required to terminate. Usually in order to terminate a trust, you need a court order.
