Fraud in divorce

Divorce 4 views 2 answers
hi , I see my spouse has transferred some money from our joint account just after divorce before we split up our accounts. My attorney withdrew 2 days before divorce and I had no representation at trial. Its been 6 months and I found this now. Does this constitute fraud ? Can I reopen my divorce by bill of review?

I do not believe this would be considered fraud since it was a joint account. An example of fraud would be if you found there were assets that he did not disclose. In that case, you would likely be able to reopen the divorce. I would advise you to look at the settlement agreement or the final order. If the account had been awarded to you as a result of a settlement agreement or the final decree and he then took money, you should file a motion for contempt. In filing that type of motion, you would want to ask to be reimbursed for attorney fees and court costs. Of course, I would also suggest consulting an attorney to discuss your issues to find the best way to handle your situation. Good luck.
