Is there anything I can do to get my sisters kids from her?
Anonymous2 views3 answers
My sister has become an addict. She's been misusing medicine and taking medicine not prescribed and is seeing an addict that shoots up things. She's had cops and cps called on her for these things as well as neglecting her kids. The father is planning on coming up from where he lives to get the kids because he's scared for his children. He lives on the opposite side of the state so he can't make it til next Sunday. He asked me if I could get the kids from her and have them stay with me so he knows they will be OK. She won't let me take them. Is there anything I can do to get the kids til their father picks them up?
The quickest thing to do, would be for the father to file an emergency motion for immediate pick up of the children. It is possible that he could designate you as a party to pick up the children. You cannot get involved - unless you were to file a guardianship case, which will take more time. Dad needs to take the lead on this one - with an attorney. As cut and dry as facts may seem, emergency motions are complicated, do not attempt to do this without experienced counsel.
It will take a court order to get the children. the father can hire an experienced family law attorney in the county that issued the custody order. While you are waiting for the father to arrive, you can meet with that same attorney to plan a strategy to protect the children.
