Can police arrest me for this?

Criminal Defense 4 views 5 answers
Police have recently contacted me indicating that someone was accusing me of sending prostitutes (escorts), food and taxis to an individuals house. I live in NY while the party accusing me is in Central New Jersey. The cop told me that it was very possible that these people could sign complaints against me and if they do, I will receive a letter in the mail. Is this legal? I thought complaints have to be served by hand. Also, the cop indicated that if this did not stop that they would send a team all the way up to NY to pick me up and put me in a county jail in NJ. Can they do this? Also, as a result my friends in NJ have told me to stay away from them or they will call the cops and sign complaints. Will that have any impact on me? How will this impact me in NY?

Yes what the police have told you can definitely happen, and I suggest that you immediately retain the service of a NJ Criminal Lawyer. In NJ a good percentage of criminal complaints that are not for violent acts, drugs charges, sexual crimes etc. are served by mail. I doubt based on what you said that they will come to NY to get you unless you live close to NJ and like the cop said continue the acts. But again I do not know your case and nor should you say more than you already have said because anything said over the internet or even the phone can be monitored by the government. Therefore, you need to setup a consultation with a criminal attorney and discuss this matter and your defenses. The sooner you retain counsel the more the attorney can do to help you and even possibly avoid the charges from being filed. One piece of advise: The fish would have never gotten caught if didn't open its mouth. Remember that and Good Luck.

First, stop discussing facts and details in a public forum. Second, consult a qualified criminal defense attorney asap.

If you did something in NY to commit a crime in NJ, you could be charged in either or both states and possibly under Federal law as well.

DPs (misdemeanors) can be served by mail in NJ. A crime (felony) warrant by personal service. A summons can be by mail under certain rules. All are within the State but once filed can be the basis for arrest in NY.
