Public defender

If my boyfriend has court in Clarksville on the 30th. If I bond him out now he will have to be transported to Robertson county to serve time there. He will get a capias for not appearing in court in Clarksville if he is in Robertson county jail. Could I hire a public defender to represent him in court in Clarksville while he is in another counties custody?

Please my answer to your previous question on trust issues. Assuming that you bond him out in one place, you should bond him out in the other, if possible. It makes little sense only to bond him out in one place for many reasons. The most important is that if you bond him out in Clarksville, and they keep him in Robertson County, he might miss his court date in Clarksville which might result in a forfeiture and a major headache for you. As for the public defender, it will depend on whether the judge thinks he meets the judge's criteria for indigency. I can tell you that most judges are less likely to appoint a lawyer if the person is out of jail on bond.

Yes, you can hire a lawyer to represent him. Based on my experiences in Clarksville and Robertson county, I'd expect the safest strategy would be for the lawyer to file a motion to move the Clarksville court date until after the Robertson County charges are resolved, so no capias is ever issued. In fact, if you're hiring a lawyer on the Clarksville case, most of us are willing to go down to Robertson county too, so you might get one lawyer to handle everything in both counties for a reasonable price.
