Are illegally issued orders through a civil court enforceable by law enforcement?

3 views 2 answers
Party A arranged for a judge to sign an order against Party B and did so without seeking response from Party B and without a hearing, as required by law. Can a third party or law enforcement prevent Party B from violating the illegally obtained/issued order? What are the ramifications via law enforcement of Party B for violating an illegally issued civil court order? What are the ramifications to a third party?

Unclear what type of case, but If your former spouse is deliberately ignoring a court order, you can file a motion called a “motion to enforce litigant’s rights”

A Court Order signed and entered by a Judge is valid and binding, and law enforcement can be asked to help enforce it. If you believe that it was entered in error, or in violation of appropriate rules and procedures, then you should 1) seek the assistance of an attorney, and 2) go immediately to the Courthouse to file an "Order to show cause" (which is why you should seek an attorney's help) to ask a Judge to temporarily rescind or stay the order until the validity and appropriateness of the Order can be resolved. Just because you say the Order is improper and should be invalidated does not mean that it necessarily is; and it remains a valid and enforceable order until a Court of appropriate jurisdiction says otherwise. Good Luck
