My husband of 34 years has recently stopped providing me with any financial or emotional support.

Because of his downturn in business, he has gone off to India and started another business, so he says. He has put in all his money into the business. Since 2004 he has separated our account and did not tell me ever about his earnings and I trusted him and never asked. I started working since 2012 and earning well now. Now he is continuously suggesting that I should divorce him. He has said he has no income. Therefore if I start any proceeding against him I will have to pay him alimony. I am 52 years old. Please advice what should I do.

This is a matter of State law. I would strongly suggest that you consult with a local attorney (perhaps selected from the website resources) with experience in this area of law, to offer a free initial consultation and perhaps assist with the process. If this information was helpful to you, even if you do not like or agree with the advice, please let me know by clicking on the “Helpful” or “Best Answer” button. Good luck!

You should hire a local attorney to review your options. It's not clear whether he's telling the truth about not having income, what he's done with marital assets, or whether he could work if he wanted to. If you're worried money is disappearing, it would be better to consult with someone sooner rather than later.

I didn't see any adequate responses so here is my two cents worth. No one can tell if you would or would not owe spousal support based on the facts stated. A full analysis under Calfifornia Family code Section 4320 is needed. As to the businesses that he started, because they were started during the marriage, then you have a right to claim a community property interest in the businesses, even if he did separate the accounts as suggested. Once a divorce is started, you can subpoena records from the bank. He had a fiduciary duty to keep you informed of his actions and dealing during the marriage and if he breached these duties under CA law, then he could be forced to compensate the community estate. As to "his" money, it may not have been "his" money but rather it may have been community money so that is the basis for my assertions above. You really need to secure the services of a family law attorney if indeed you need to file for divorce or for legal separation.
