How can the Social Security Administration be required to restore my retirement benefits due to a problem they ignored?

Business 4 views 3 answers
My personal retirement benefits are being withheld by SSA six years after I asked them to investigate an employee of my company whom the agency approved (twice) as a competitor in the same field. She embezzled money from my company (as a Representative Payee agency), set up her own company and unlawfully broached clients' personal information and transferred a number of my clients to her company, while continuing to represent my firm with SSA's direct knowledge. In response to my request for an investigation by the Inspector General's Office, SSA chose to audit my records and terminate my company, while maintaining the previous employee in that capacity. The IG's Office never responded to my request for a full scale investigation.

You have the right to administrative appeal for any Social Security determination. The issue you face is that you may very well be timebound in being able to bring the appeal after six years. Get a consult with a local attorney to review the particulars.

This is a difficult issue that may very well be time barred. With luck, an Atlanta social security attorney will be able to assist. Use the "find a lawyer" tab on your screen. Because this is far from the usual situation you may have to speak to several attorneys before you find one willing to take such a case.

I think also that a big question concerns, why did the SSA curb YOUR personal benefits. It is one thing to terminate its professional relationship with you, i.e. no longer allow your company to be an approved institutional RP, but another thing to invade your personal benefits - unless it feels you had an 'overpayment'. If you are time barred, the question remains, how long are your personal benefits infringed upon? Forever? If they do not accept an appeal, I'd also try to contact my Congressperson to see if he or she could intervene to at least get the answers.
