Child support establishment...other parent hiding money. What to do?

Child Support 4 views 3 answers
My question involves child support in the State of: FL Hi guys! I'm trying to obtain some knowledge on what do in my custody case? I'm in the process of obtaining support for my 10 year old son. I haven't receive support in the last 2 years due to jurisdiction issues. Luckily FL allows for 24 month retroactive. I am the father by the way. Mother also filed a bogus child custody case to avoid paying while support. She is now trying to delay the process by hiding information. She make over 130k and owns tow homes and hasn't provided for our son in the last two years. She just obtained a quit claim deed for rental property she owns after I filed for child support this January. The quit claim deed puts her mother as the now owner of the property. I guess what she is doing here is trying to lower her income by assigning the property to her mother, thereby eliminating the rental income from the child support calculation. Those were my thoughts when I came to know about it. What do you guys think she is doing with the quit claim deed? Is it evident that she is doing this to lower her obligation? Besides the above I obtained bank statements from her and for her checking account, she only has 2k and for her savings she has only another 5k... Remember she makes over 130k/year. Am I missing something? What should I be doing? What can I do about the bogus quit claim deed she filed to lower child support? Can it be considered criminal for her to be doing this? She is also making up bogus expenses on her tax returns to lower her total income, but she is not providing evidence of those expenses.

Mr. Nemiro is correct, child support is based upon income, not assets. However, if those assets produce income, that would be relevant. As stated, child support is based upon income of the parties. The situation you describe, however, seems to indicate that there may be income sources that she is attempting to hide. I'd suggest you consult with a family law attorney in your area to discuss your best options for getting to that information. Most family law attorneys offer free consultations, and as this can be a complicated matter, use of an attorney would be recommended.
