i went had xbox live account hacked and it took me over 2 weeks to get my account back then i saw 200 dollars worth of charges made on my debit card so i call MIcrosoft and told them about the charges that were brought up but they could not give me a refund do to that i had my debit card cancel so then i call my bank to dispute the charger and they told me that they will have an investigator look into the charges would i have to go to court or have to do anything to be able to get my refund back

If you've already disputed the charges with your bank, you will have to go through that process. It is likely that your bank will require you to take the dispute to arbitration with them, rather than go through the traditional court system. The same is probably true of Xbox Live.
