Should I fight my $83.00 parking ticket?
Anonymous4 views5 answers
I received a parking ticket yesterday but there were no signs that stated no parking when I initially checked the street and later found out that at the other end of the block (300-400 ft away) there is a sign that is completely covered by a tree that states no parking. This was the only sign on the street that stated no parking so not only was it well out of sight due to distance, but it was not visible due to the tree. I also have pictures of everything and I was wondering if I should fight it?
When faced with payable tickets I find it is best to weight the costs and benefits. With a simple parking ticket that you believe you have a defense to - like what you have, the benefits could be the money saved on the fine and a sense of justice. The costs however, can be great when you consider the time you will have to spend in court. Imagine if you will, having to miss work on 2 or 3 occasions to have a trial where the judge believes the issuing officer acted in good faith and finds you guilty.
I agree with attorney Ehrlich not worth your time to fight it. Sorry for your troubles unfortunately this is what happens when police get pressured to write tickets in an area for money and the towns don't use that money to trim the bushes but instead use it for other projects making it unfair for all.
You should fight it only if you believe it is worth your time and energy. Bear in mind that the two main objectives in any Municipal Court is to make money for the town and to keep the line moving. Trying a parking ticket case clogs up the line, which will not make the Judge happy, and that Judge may not buy your argument that a tree covered the No Parking sign.

Sounds like a defense. You may win. Takes lots of pictures. Then go to court. You do not say which one. But in most take the day off work. Sit there for hours and show the prosecutor the pictures. He may give you a break. You win. He may say he needs to talk top the cop. The cop may be off. take another day off. Then they may want a trial. could be that day could be a third day off. And you could lose and pay court costs on top of the ticker. What do you think.
