How and when can I change my last name to married name?
Anonymous6 views4 answers
My husband and I got married in 2013 and filed the I-130 form using my maiden name, and our application was approved. Then we filed I-485 along with I-131 and I-765 and EAD and AP was granted, but I-485 is still pending. I have recently replaced my documents to reflect my married name, including passport, DL and SS card. Now it is time to renew my EAD/AP card and I am wondering how can I notify the USCIS about the name change, considering the application is still pending. Of course, I would want my EAD/AP card and subsequently my green card to have my married name not to cause any confusion.
I would appreciate any input. Thank you!
It would have been best to file your I-130 and I-485 documents using your married name. However, it's not too late. When you go to your I-485 interview, tell the officer that you would like to use your married name, and they can make that change on your I-485 application, so that you can be issued your legal permanent resident card in your married name.
The easiest way will be to wait until your adjustment interview. However, remember that USCIS will have to run separate security checks using your married name which can potentially delay approval of your adjustment of status. Each local jurisdiction has its own preference on how to deal with amendments and changes, so you should contact a local attorney. As far as timing, it is best to wait until the interview and then bring it up with the Officer adjudicating your case.
