Phone repair shop employee was sending personal pictures from my phone to his cell phone during repair. Do I have a case?

I turned my phone in to get repaired at a small repair shop. I have proof that one of the employees was sending private pictures from my phone to his personal phone. My phone and my laptop are linked, so when messages are sent from my phone, I see exactly what was send and who it was to. My privacy was invaded and I am curious to know if I have a case against the shop.

What damages do you believe you've incurred? While it seems highly unprofessional and creepy, I'm not sure you've suffered any calculable harm. Still, you should consult with a local attorney whose practice includes privacy rights. Perhaps with more detail a viable claim will emerge.

You do have a case, specifically for the tort of invasion of privacy. However, what remedy are looking for? For a judgment of monetary value you will need to prove damages. You should consult with an attorney as soon as possible.
