IS my Divorce Valid???

Divorce 2 views 3 answers
I was married in India by special marriage act on Dec-4-2013 and we got divorced on June-25-2015. Since I am currently residing in USA and involved in grad school and a job, I was unable to appear for the court. Hence the divorce was an ex-parte issued by the court. My Question is will this divorce will anyway affect my current immigration status (F1). My ex-husband does not live in US nor he has an US income or SSN, neither he is a dependent .Also can this divorce affect in future if I apply for greencard (through employer or spouse) since this was an ex-parte divorce? I am currently in Wisconsin, is this divorce valid here in this state?

This is a good question. But not one for US Immigration Lawyers. Talk to an attorney licensed in India. The US will recognize properly executed marriage/divorce from a foreign country.

If you have a certified copy of your divorce decree and met all of the legal requirements for a divorce in your country, whether you appeared or defaulted, why wouldn't the divorce be valid? On your other question in terms of how it may affect your right to be in the United States, you should repost your question as an immigration law issue, to see if someone who is well versed in immigration law can answer your question.

Getting married or divorced, by itself, is not a violation of one's F1 status.
