Can I get child support set at zero?

3 views 3 answers
I am requesting an order to reduce child support, my ex wife put on her I&e declaration she makes $6114 a month as school psychologist, I put on my I&e declaration that I make $1,600. I get %13 visitation, commissioner said there is change of circumstances bc my new job, Court ordered us to fill out current I&e declaration, my ex has bachelors, masters degrees, and pupil personell service degree. My ex is now saying she is unemployed bc school is out, and she's looking for new job. My ex has had 14 years to find full time employment, with masters degree alone! Can I ask court to find her underemployed under family code 4058 (b) in open court? I have not requested order, to impute, or find ex underemployed, bc commissioner wants to see I&e that's all im allowed to file.

Not enough facts here to answer. I suggest you retain a local atty specializing in family law.

You still have to pay child support even if the custodial parent makes more than you.
