In Illinois - Out-of-state plates but cited for 0976160A for non "front-and-back" license plate compliance (Wisconsin plates)

Hi. This afternoon I was cited for not having a license plate front and back on my vehicle in the state of Illinois. Having out-of-state license plates from Wisconsin, I do not understand this citation. QUESTION: Would Illinois Law require mandatory that every out-of-state vehicle display front and back license plate for municiple code "0976160A"? I am strongly considering to contest my violation.

I haven't personally run across the case myself of this rule being applied to non-Illinois residents but I have spoken to other practitioners who have. In my recollection, providing proof that your vehicle, registered in Wisconsin, was in compliance with your home state's laws. I can imagine that most prosecutors would consider dismissing the ticket under those circumstances but this is again, a bit speculative as I have not yet had a client with this unique situation. I would recommend speaking to other attorneys and seeing if they have had challenging this ticket play out like this. Hope that helps! Jason A. Wilkins Attorney at Law

I appreciate my colleague's advice, but I want to offer a different perspective. In Colorado, where I practice, you are expected to comply with our rules of the road upon crossing the state lines. Thus, in our state, where a plate on both front and back is required, you can expect a citation if you have just the one. Good luck!!

Our prosecutors uniformly yield to one plate states. You don't come from a one plate state. The section you cite must be a local ordinance but the ticket appears righteous to me.

If your state requires only a rear plate, then you have a defense. However, Wisconsin is a two plat state and therefore you were in violation. Police officers have the resources to learn which statesrequire plates front and back.
