Custody Modification/Suspected Abuse
Anonymous3 views2 answers
If a child less than age of 10 said that her mothers boyfriend grabbed her tightly by her waste and proceeded to yell and call her names because she got upset would this be grounds to limit the exposure there? I have full custody, she was there for visitation and she was left alone with him, so it was not witnessed but the child is saying he hurt her ribs. (no bruising was found because we found out 2 weeks later). The child told the mom and she took no action. After he left them stranded an hour away from home the mother then contacted us. We have the child back home now and she is safe, but the mother admitted over the phone that she knew he was not good with his own kids, so why would she leave my daughter with him alone?

This could be grounds for modification of visitation. I would consult with a local family law attorney for more information and an in depth analysis of the facts related to your case; including any evidence that you may have.
It would appear that this is something that could be used to change or modify any agreement. As for any potential abuse, if you wish to seek criminal charges, I would suggest either contacting the police department or taking your daughter to see the Magistrate. If you are only interested in a custody modification, then you could talk with the attorney who handled the agreement the first time for you, or talk to someone new.
