Do I have a chance at getting an extension?

I was serve with a notice for non-payment of a commercial rental for my business. I had an enormous delay in opening (still not open) due to a lack of a C of O. There was a violation from the previous tenants which was just recently lifted. I've been renting the location for almost 2 years now. I've made some payments but not many and would like an extension on making payments. My plan is to get it open asap but I can only move as fast as the building's dept allow. I answered the summons and will be in court Thursday. Do you think I have a chance? I owe around $120K. I would like an extension on a portion of the moneys. The balance to be paid month to month in addition to the rent due, but only after I get 3 months to make it all happen.

Dear Bronx Business Owner: Why did your commercial lease lawyer allow the rent to start without a proper Certificate of Occupancy in place first? In any case, I gather your business is not a corporation, otherwise you already would have a lawyer on the nonpayment case. The "simplest" way for the landlord to "win" and take some more of your money in the process is to make the deal you want. Your landlord will take a chance that you will pay or will not pay and get evicted without need to prove the rent claim in court or allow you to prove you do not owe the rent. If the landlord takes the deal you offer and you pay some but not all you will be evicted anyway. Why not hire a lawyer?

You should seek additional time to obtain an attorney. Using an attorney will help you negotiate the process of seeking an extension.
